3. Why We Collect Your Information
We collect and process personal information for the following purposes:
- To evaluate and process your rental application
- To enter into and manage your rental agreement
- To collect weekly rental payments via debit order
- To track GPS location data of rented bikes for security and operational purposes
- To contact you regarding your application, rental, or account
- To comply with South African legal and regulatory obligations
- To investigate incidents of theft, damage, or misuse of rented bikes
- To improve our services and website
4. Legal Basis for Processing
We process your personal information on the following grounds under POPIA:
- Contract: Processing is necessary to fulfil our rental agreement with you
- Legal obligation: We are required to retain certain records under South African law
- Legitimate interest: GPS tracking of rental assets is a legitimate business interest
- Consent: Where we rely on consent, you may withdraw it at any time
5. GPS Tracking
All rented bikes are fitted with 4G GPS tracking devices that record the bike's location in real time. By entering into a rental agreement with Bikes 2 Share, you acknowledge and consent to GPS tracking of the bike for the duration of your rental. This data is used for:
- Asset security and theft recovery
- Verification of bike usage and rider location
- Investigation of incidents or disputes
GPS tracking data is not sold to third parties and is not used for purposes unrelated to the rental of your bike.
6. Who We Share Your Information With
We do not sell your personal information. We may share it only in the following circumstances:
- Payment processors: Your banking details are shared with authorised payment service providers solely for debit order processing
- Law enforcement: Where required by law or to investigate theft, we may share information with SAPS or other authorities
- Delivery platforms: We may share basic verification information with delivery platforms to assist your rider onboarding where you have consented
- Service providers: We may share information with IT, hosting, and communications providers who process data on our behalf under data processing agreements
7. How Long We Keep Your Information
- Rental agreement and payment records: 5 years from the end of your rental, as required by South African law
- GPS tracking data: 12 months from the end of your rental, or longer if required for a legal dispute
- Application data (unapproved applicants): 12 months
- Communication records: 3 years
8. Security of Your Information
We take reasonable technical and organisational measures to protect your personal information against unauthorised access, loss, or misuse. These include secure data storage, access controls, and encrypted communication channels. No data transmission over the internet is completely secure; we cannot guarantee absolute security but we are committed to protecting your information to the best of our ability.
